Escalation is built into the system. When the standard letters do not produce payment, the file is passed to the next stage. That next stage may be a debt collection agency, a bailiff firm, a magistrates' court summons, or in some cases a committal hearing. Each of these arrives in a fresh envelope and is designed to feel like a new and worse problem. In lawful terms, each is just another point in the same sequence.
The mindset
Do not panic when escalation arrives. Panic is the response their machine is designed to produce. Panic makes you ring the helpline, agree to a payment plan, give a card number, and undo months of careful position-building in five minutes on the phone. Whatever arrives, set it down, make a cup of tea, read it twice, and decide on the next document in the sequence before you take any action.
Bailiffs
A bailiff visit is the most theatrical form of escalation. They arrive in a uniform, often in pairs, sometimes with a vehicle marked for towing. Their power, in lawful terms, is narrow. They cannot enter your home without permission unless they have already gained peaceful entry on a previous occasion. They cannot break the door. They cannot take goods that are essential to your livelihood. They cannot operate on private property without the consent of the lawful occupier.
Your response: do not open the door. If they speak through the door or letterbox, you say, calmly, that you do not consent to their presence on the property and that any further communication must be in writing. You do not argue. You do not explain your lawful position at the doorstep. You close the conversation, and you serve a Notice of Conditional Acceptance and a notice of trespass on the bailiff firm by post within twenty-four hours.
Court summons
A magistrates' court summons looks heavy and is designed to look heavy. It is a notice that a hearing has been scheduled. It does not, by itself, mean a verdict has been reached. Your response is the next document in the sequence: an affidavit of truth on the court file, a written demand for proof of jurisdiction, and a careful decision about whether to attend.
Hold the line
Escalation is the test. The whole sequence to this point has been preparation for it. Stay in the work. Send the next document. Keep the records. Refuse, calmly and clearly, to give them the panicked admission that would dissolve everything you have built.
